“Although I had previously negotiated more than 30 real estate transactions, including 2 in Mexico, the purchase of a small home in Patzcuaro was a particular challenge and I needed Liliana’s legal guidance. The seller refused any form of binding purchase/sale contract and wanted to proceed only under a handshake agreement to exchange money for a deed at the notario’s office. As the deed would not be recorded until weeks after the cash was transferred, seller’s conditions raised several obvious concerns in addition to normal concerns about title history. Facing these challenges, Liliana arranged an institutional escrow as intermediary to control funding and to document the parties and the transaction; she negotiated the escritura (deed) with the notario to make a proper record of the parties and establish the correct tax value upon transfer; and, she arranged for title insurance. After weeks of diligence, seller’s “no-contract” deal ended up closing smoothly and recording with all appropriate features of a properly structured real estate transaction.
